Beam Me In Terms of Service

1. Introduction

Welcome to Beam Me In, Inc. (“Beam Me In”, “BMI,” “Company,” “we,” “us,” or “our”). 

Beam Me In is a Software-as-a-Service (SaaS) platform designed to provide users with virtual commercial property visualization, interaction, and management solutions. Our services include, but are not limited to, virtual property tours, interactive digital spaces, data hosting, and proprietary software applications.

These Terms of Service (“Terms”) govern your access to and use of the Beam Me In website (www.beammein.ai) and all related services, applications, tools, and content (collectively, the “Service”).

By accessing, registering, or using the Service, you acknowledge and agree to be legally bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must immediately cease all use of the Service.

These Terms apply to all visitors, users, clients, and entities who access or use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Account Registration & User Responsibilities

• Accept responsibility for all activities that occur under your account.

You acknowledge that Beam Me In is not responsible for unauthorized access to your account due to the loss or theft of your login credentials.

3.2. Prohibited Activities (Acceptable Use Policy)

You agree not to use the Service for any unlawful, prohibited, or malicious purposes, including but not limited to:

• Uploading, transmitting, or distributing any content that is illegal, harmful, defamatory, obscene, or misleading.
• Attempting to hack, disrupt, or interfere with the Service, servers, or security systems.
• Reverse engineering, decompiling, or modifying any part of the Service without express authorization.
• Using automated bots, scrapers, or similar tools to extract data from the Service.
• Engaging in fraudulent activities, including misrepresenting your identity.

Violations of this policy may result in account suspension, termination, and legal action.

4. Subscription, Billing & Payment Terms

4.1. Subscription Plans & Automatic Renewals

Beam Me In offers both free and paid subscription plans. By subscribing, you agree to:

• Pay all applicable fees as outlined on our pricing page.
• Allow automatic renewal unless canceled before the renewal date.
• Maintain valid payment information to prevent service disruptions.

4.2. Refund Policy

All payments are non-refundable, except where required by law.

5. Intellectual Property Rights

All intellectual property, including the software, trademarks, logos, and content associated with Beam Me In, is owned by or licensed to Beam Me In, Inc.

Users may not:

• Copy, modify, distribute, or create derivative works of the Service without written consent.
• Use Beam Me In trademarks or branding without authorization.

Users retain ownership of their uploaded content but grant Beam Me In a worldwide, royalty-free license to use, display, and distribute their content for the purpose of operating and improving the Service.

6. Disclaimer of Warranties

The service is provided “as is” and “as available” without warranties of any kind. 

To the maximum extent permitted by law, Beam Me In disclaims all warranties, express or implied, including but not limited to: 

• Warranties of merchantability fitness for a particular purpose and non-infringement. 
• Warranties that the service will be uninterrupted, error-free, or free of viruses. 

Your use of the service is at your own risk. 

7. Limitation of Liability

To the fullest extent permitted by law, Beam Me In shall not be liable for: 

• Indirect, incidental, or consequential damages.
• Loss of profits, data, business opportunities, or service interruptions. 
• Unauthorized access to or alteration of your transmissions or data.

Maximum liability: Beam Me In’s total liability shall not exceed the fees paid by you in the last 12 months.

8. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware.

Any disputes must be resolved exclusively in the courts of New Castle County, Delaware.
